1. Acceptance of Terms
These Beta Service Terms of Use ("Beta Terms") govern your access to and use of the pre-release, beta, or early-access version of LEANOX.AI (the "Beta Service") made available by LEANOX.AI ("we," "us" "ours"). By creating an account, clicking "I Agree," or otherwise accessing or using the Beta Service, you ("User," "you") confirm that you have read, understood, and agree to be bound by these Beta Terms, in addition to our general Terms of Privacy Policy, which are incorporated by reference. If you do not agree, you must not access or use the Beta Service.
2. Nature of the Beta Service
You acknowledge and agree that the Beta Service is a pre-release version of the product, made available for evaluation and feedback purposes only, and is not a final, generally available commercial release. The Beta Service:
- may contain bugs, errors, inaccuracies, and other problems;
- may not operate correctly, or as intended, or at all;
- may be modified, suspended, limited, or discontinued at any time, in whole or in part, without notice and without liability;
- is not intended for production, mission-critical, or business-critical use; and
- may be subject to different or additional features, limits, and functionality than any future commercial version.
You should not rely on the Beta Service for any purpose where failure, inaccuracy, downtime, or data loss could cause harm, financial loss, or other damage.
3. No Availability or Uptime Commitment
We makes no commitment, representation, or warranty — express or implied — regarding the availability, uptime, continuity, response time, or performance of the Beta Service. The Beta Service is not covered by any Service Level Agreement (SLA), and no specific uptime percentage, response time, or support turnaround is guaranteed. We may suspend, restrict, or terminate access to the Beta Service, or any part of it, at any time, for any reason or no reason, without prior notice and without any liability to you.
4. Disclaimer of Warranties ("As Is" / "As Available")
THE BETA SERVICE IS PROVIDED STRICTLY ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, We DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We Do NOT WARRANT THAT THE BETA SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE, PRESERVED, OR RECOVERABLE. YOUR USE OF THE BETA SERVICE IS ENTIRELY AT YOUR OWN RISK.
5. Limitation of Liability; No Obligation
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL HAVE NO LIABILITY OF ANY KIND ARISING OUT OF OR RELATED TO THE BETA SERVICE, INCLUDING BUT NOT LIMITED TO ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR DAMAGES RESULTING FROM DOWNTIME, DATA LOSS OR CORRUPTION, SECURITY INCIDENTS, OR ANY IMPACT OF THE BETA SERVICE ON YOUR SYSTEMS, DATA, OR OPERATIONS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, THE COMPANY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF THE BETA SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE BETA SERVICE, IF ANY
We assume no obligation to provide support, maintenance, updates, bug fixes, or backward compatibility for the Beta Service, and no obligation to convert, migrate, or preserve any data created or stored within it.
6. Data Collection and Use
In connection with your use of the Beta Service, We may collect usage data, diagnostic information, crash reports, feedback, and other data generated by or about your use of the Beta Service ("Beta Data").
Permitted use — internal product improvement only:
We will use Beta Data solely for internal purposes related to evaluating, testing, debugging, and improving the Beta Service and the Company's products ("Internal Improvement Purposes"). Beta Data will not be:
- sold to any third party;
- used for third-party advertising or marketing purposes;
- shared with any third party, except service providers who process it on the Company's behalf under confidentiality obligations, or as required by law; or
- used for any purpose other than Internal Improvement Purposes, without your separate, explicit consent.

7. Feedback
If you choose to submit comments, suggestions, bug reports, or other feedback regarding the Beta Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate that Feedback into its products and services without any obligation or compensation to you.
8. Confidentiality
Unless the Beta Service is publicly announced by the Company, you agree to keep confidential the existence, features, and performance of the Beta Service, and not to publish reviews, screenshots, benchmarks, or other disclosures about it without the Company's prior written consent.
9. Termination
We may suspend or terminate your access to the Beta Service at any time, with or without cause or notice. You may stop using the Beta Service at any time. Sections 3–8 of these Beta Terms survive termination
10. Changes to these Beta Terms
We may update these Beta Terms from time to time. Continued use of the Beta Service after changes take effect constitutes acceptance of the revised Beta Terms.
11. Governing Law
These Beta Terms are governed by the laws State of Israel, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa.
